Argentina ENACOM Changes New Label Requirement
On August 12th, 2022, the Ente Nacional de Comunicaciones (ENACOM) in Argentina published Note NO-2022-83513667-APN-DYNART#ENACOM to introduce a change of criteria regarding the acceptance of regulatory labeling requirements on Renewal requests.
Originally, the regulatory indicated that the CNC marking based on Resolution CNC 82/2015 and the RAMATEL marking based on Resolution ENACOM 854/2020 can both be used to comply with the regulatory labeling requirements until Aug 12th, 2022. As of that date, for new applications of the certification, only the RAMATEL label design will be accepted due to the implementation of new Resolution 854/2020; as for the homologated device, it is allowed to keep using the existing CNC label design when it comes to the renewal process.
However, from now on, with the latest publication of Note NO-2022-83513667-APN-DYNART#ENACOM, ENACOM will only accept regulatory label design based on the RAMATEL marking introduced by Resolution No. 854/2020 for new applications and renewal requests.
After all, the newly published note is significantly different from the previous standards formulated by ENACOM regarding regulatory labeling requirements on Renewal requests, and is expected to cause a sudden change on existing homologated products. So far, the latest news from the ENACOM is that for renewals a real photo showing the CNC design along with the new label draft proposal of the RAMATEL design will be required. Since the regulator still hasn’t clearly indicated the details of the transition between the two label designs, it is recommended that the homologated product with the CNC label design switch to the RAMATEL label design as soon as possible.
