Mexico: IFT Updates Telecommunications and Broadcasting Conformity Assessment Procedure
The RF regulator of Mexico- Instituto Federal de Telecomunicaciones (IFT) has released updates to the “Conformity Assessment Procedure for Telecommunications and Broadcasting” (Procedimiento de evaluación de la conformidad en materia de telecomunicaciones y radiodifusión, PEC) on December 27th, 2021.
The purpose of this modification is to respond to the public consultation that IFT opened on April 21st,2021 until June 19th,2021, during which all parties concerned have voiced their opinions and comments to IFT about the PEC regulations that came into effect on February 25th, 2021.
The new updated PEC procedure will enter into force on June 25th, 2022 and includes the following modifications:
1. The holder of the certificate of the conformity will be allowed to include its distributors and importers to use the same certificate.
2. Test report validity will increase from 60 days to 120 days. And the test reports will not be mandatory submitted to IFETEL, however IFT may request the lab to share the reports when it is required. This change is made due to the manufacturer’s confidentiality concerns.
3. The extension of the Certificate of Conformity in the “Sample by Product Model and Surveillance for more than one Lot” scheme, (Scheme 2) will be subject to a documentary analysis, as well as the corresponding record of the additional lots that are requested to be expanded in a Certificate Compliance, without requiring new test reports.
4. The number of samples is reduced to 1 sample for Schemes 1, 2 and 4; except in cases where the applicable technical provisions specifically indicate, the obligation to present more than one sample. For Scheme 3 (Family Approval), 1 sample of 2 different models will be required.
5. The new Regulations will now apply to used, second-hand, rebuilt or similar products where as in the original regulation it only applied to new products only.
